Covid-19 mRNA shots are not vaccines? A ruling by the Ninth Circuit Court of Appeals answers that question with a hard yes.

Yes, that Ninth Circuit Court of Appeals. I will explain what I mean about that observation in a bit.

For now, this ruling is huge. Why? This could strip pharmaceutical companies of legal liability protection. Put simply, the ruling could set the stage for lawsuits against the mRNA shot manufacturers.

The Health Freedom Defense Fund (HFDF) triggered this ruling with its lawsuit against the Los Angeles Unified School District . What was the nature of the lawsuit? No , it could’t be the mandates. Oh wait, that was the reason!

You know the schtick:” Nice job you have here. Would be a shame if something happened to it because you didn’t get vaccinated.”

Turns out “vaccine” is the wrong terminology for the shots, according to the court. While marketed to the public as vaccines, the court ruled the shots do not effectively stop the transmission of Covid-19. While they may reduce symptoms in the affected, that’s not enough to make the shots, traditional vaccines.

What is a vaccine? The Supreme Court of the United States ruled in Jacobson v. Massachusetts (1905) that vaccinations prevent the spread of diseases like smallpox, not reduce the symptoms in the infected.

The ruling reverses a lower court’s dismissal of the case against LAUSD’s vaccine mandate. LAUSD’S policy was , of course, buoyed by the Centers for Disease Control (CDC) changing the definition of a vaccine in 2021, from “a product that stimulates a person’s immune system to produce immunity to specific disease,” to ” a preparation that is used to stimulate the body’s immune response against diseases.”

The press may have never questioned the semantics games of the CDC with any intensity , but the Ninth Circuit certainly did. Amazing, when you consider conservative critics used to label this appellate jurisdiction the “Ninth Circus Court of Appeals “due to the volume of overturned rulings . Some legal experts are confident this ruling will stand.
